Terms of Use

Welcome to Auglie. These Terms of Service ("Terms") govern your use of the Auglie mobile application and services provided by Augmntd ("we," "our," or "us"). By downloading, installing, or using our app, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Auglie, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our service.
2. DESCRIPTION OF SERVICE
Auglie is a premium subscription-based digital wardrobe and outfit creation application that provides:
Free Features (Limited):
- Account creation and basic app navigation
- Limited wardrobe item additions
- Basic outfit browsing
- Access to subscription information
- Trial access to premium features
Premium Subscription Features:
- Extended wardrobe item additions and management
- Full outfit creation and combination tools
- AI-powered outfit image generation
- Advanced styling recommendations
- Generation credits for AI-created content
- Cloud synchronization and secure backup
- Premium styling tools and features
- Priority access to new features
Credits System:
- Subscribers can purchase additional credits for AI generation
- Credits are used for generating outfit images and AI-powered features
- Credit top-ups are available as in-app purchases
- Credits do not expire while subscription is active
- Unused credits may be forfeited upon subscription cancellation
Important: Core wardrobe management and AI generation features require an active subscription. The app is designed as a premium service with subscription-only access to primary features.
When downloaded through app distribution platforms, this agreement is concluded between you and Augmntd only. We are solely responsible for the application and its content. Platform providers have no obligation to provide maintenance or support services.
3. ELIGIBILITY AND ACCOUNT CREATION
- You must be at least 13 years old to use Auglie
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You may not create multiple accounts or share your account with others
- You must notify us immediately of any unauthorized use of your account
- Users under 18 should have parental consent to use the service
- You represent that you are not located in a country subject to government embargo or designated as supporting terrorism
- You are not listed on any government list of prohibited or restricted parties
- You must comply with applicable third-party terms when using the service (such as wireless data service agreements)
4. SUBSCRIPTION TERMS AND BILLING
Subscription Model:
- Auglie operates on a subscription-based model
- Core wardrobe and AI generation features are only available to paid subscribers
- Free trials may be offered to new users
- Multiple subscription plans may be available (monthly, yearly)
Credits and Top-Ups:
- Subscribers can purchase additional credits for AI generation
- Credits are separate from subscription fees
- Credit purchases are processed through the Apple App Store
- Credits are non-refundable except as required by law
- Credit balances may be viewable in your account settings
- Unused credits may expire or be forfeited if subscription is canceled
Billing and Payment:
- All subscriptions are processed through the Apple App Store
- Subscription fees are charged to your Apple ID account
- Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
- You can manage your subscription through your Apple App Store account settings
- Subscription fees are generally non-refundable except as required by law or App Store policy
Free Trial Terms:
- New users may be eligible for a free trial period
- Trial length and availability may vary
- Payment will be charged after the trial ends unless canceled
- You can cancel during the trial period without charge
- Trial eligibility is typically limited to one per Apple ID
5. USER CONTENT AND DATA OWNERSHIP
Your Content Ownership:
- You retain full ownership of all wardrobe items, outfit combinations, images, and other personal content you create or upload
- You are solely responsible for your content and its accuracy
- You must ensure your content does not violate these Terms or applicable laws
- You can export or delete your content at any time
- You must have the right to upload any images you add to the service
Content Processing Rights:
You grant us a limited, non-exclusive license to:
- Process your content to provide our premium services
- Use AI to generate outfit images based on your wardrobe items
- Analyze your wardrobe and outfit combinations to provide styling recommendations
- Process images you upload for organization and enhancement
- Create personalized suggestions based on your wardrobe and style preferences
- Store and synchronize your content across your devices
Data Protection:
- We process your content solely to provide our services to you
- We implement strong security measures to protect your personal content
- We do not share your personal content with third parties except as described in our Privacy Policy
- We may use aggregated, anonymized data to improve our services
- All processing is subject to our Privacy Policy and applicable data protection laws
6. PROHIBITED CONDUCT
You agree not to:
- Use the service for any illegal or unauthorized purpose
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Upload harmful, threatening, abusive, defamatory, or offensive content
- Share content that violates others' privacy or contains personal information without consent
- Upload images you do not have rights to use
- Attempt to gain unauthorized access to our systems or other users' accounts
- Reverse engineer, decompile, disassemble, or modify our software
- Use automated tools, bots, or scripts to access or interact with our service
- Attempt to circumvent subscription requirements or payment systems
- Share your account credentials or subscription access with others
- Upload malicious code, viruses, or harmful software
- Use the service to spam, harass, or abuse other users or our support team
- Resell, redistribute, or commercially exploit AI-generated content without proper rights
- Generate inappropriate, offensive, or illegal content using our AI features
7. ARTIFICIAL INTELLIGENCE AND DATA PROCESSING
AI Feature Disclosure:
- Our premium features use artificial intelligence to generate outfit images and styling recommendations
- AI processing analyzes your wardrobe items and style preferences
- Images you upload may be processed using AI for organization and enhancement
- AI generation creates original visual content based on your inputs
AI Limitations and Disclaimers:
- AI-generated content is provided for personal use and entertainment purposes
- AI analysis and generation may not always be accurate or meet your expectations
- We do not guarantee the accuracy, quality, or suitability of AI-generated content
- AI-generated images may occasionally contain artifacts or unexpected elements
- Generated content should be reviewed before sharing or using publicly
- AI output quality depends on input quality and may vary
Data Processing Consent:
- By using premium features, you consent to AI processing of your content
- You can withdraw consent by canceling your subscription and deleting your account
- Processing occurs through secure, third-party AI service providers
- All AI processing is subject to our Privacy Policy
AI-Generated Content Rights:
- You retain rights to AI-generated content created through our service for personal use
- AI-generated content is created based on your inputs and wardrobe data
- We retain the right to use anonymized data to improve our AI models
- Commercial use of AI-generated content may require additional licensing or permissions
- Some AI-generated content may be subject to the terms of our AI service providers
8. PRIVACY AND DATA PROTECTION
- Your privacy is important to us and is governed by our Privacy Policy
- We collect and process data as described in our Privacy Policy
- You have various rights regarding your personal data as outlined in our Privacy Policy
- We implement appropriate security measures to protect your data
- You can request access, correction, or deletion of your data at any time
- Data processing complies with applicable laws including GDPR and CCPA
9. INTELLECTUAL PROPERTY
Our Property:
- The Auglie app, including its design, features, algorithms, and underlying technology, is owned by Augmntd
- Our trademarks, logos, brand elements, and proprietary content are protected intellectual property
- You may not use, copy, or distribute our intellectual property without express written permission
- These Terms do not grant you any ownership rights in our service or technology
License Grant:
- The license granted to you is non-transferable and limited to use on devices you own or control
- You may access the application through authorized family sharing or volume purchasing programs where available
- Your license is subject to platform usage rules and restrictions
Intellectual Property Claims:
- Augmntd is solely responsible for investigating, defending, and resolving any third-party intellectual property infringement claims
- We will handle any claims that the application infringes third-party intellectual property rights
User Content and Third-Party Rights:
- You represent that you have the right to upload and use all images and content you submit
- You are responsible for ensuring your uploads do not infringe copyright, trademark, or other rights
- We may remove content that violates intellectual property rights upon notice
- Repeated copyright violations may result in account termination
Feedback and Suggestions:
- Any feedback, suggestions, or ideas you provide about our service become our property
- We may use feedback to improve our service without compensation to you
- You waive any rights to feedback or suggestions you provide
10. SERVICE AVAILABILITY AND MODIFICATIONS
Service Availability:
- We strive to maintain service availability but cannot guarantee uninterrupted access
- We may temporarily suspend service for maintenance, updates, or technical issues
- We are not liable for service interruptions, downtime, or technical problems
- Some features may be temporarily unavailable during updates
- AI generation services depend on third-party providers and may experience occasional outages
Service Modifications:
- We may modify, update, or discontinue features at any time
- We may change subscription pricing with reasonable notice
- New features may be added to existing subscription plans
- Some features may be moved between subscription tiers
- Credit pricing and allocation may be adjusted with notice to users
- Material changes will be communicated to users in advance
11. DISCLAIMERS AND LIMITATIONS
Service Disclaimers:
- Auglie is provided "as is" without warranties of any kind
- We disclaim all warranties, express or implied, except as required by law
- We do not warrant that the service will be error-free or uninterrupted
- AI-generated content is provided without warranty of accuracy, quality, or suitability
- We do not guarantee that AI generation will produce expected or satisfactory results
- Generated content may occasionally contain unexpected elements or artifacts
Platform Refunds:
- If you purchased through an app store and the application fails to conform to applicable warranties, you may contact the platform provider for a refund according to their refund policies
- Platform providers have no other warranty obligations regarding our application
- Any warranty claims beyond platform refunds are our sole responsibility
Fashion and Style Disclaimer:
- Auglie is a creative tool for personal wardrobe management and outfit visualization
- We do not provide professional fashion advice or styling services
- Outfit suggestions and AI-generated content are for inspiration and entertainment purposes only
- Style recommendations are automated and may not suit all occasions or personal preferences
- You are responsible for making your own fashion and style decisions
12. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
- Our total liability to you is limited to the amount you paid for our services in the 12 months preceding the claim
- We are not liable for indirect, incidental, consequential, punitive, or special damages
- We are not liable for loss of data, profits, revenue, or business opportunities
- We are not liable for third-party actions or content
- We are not liable for the quality, accuracy, or suitability of AI-generated content
- We are not liable for any decisions you make based on app content or recommendations
- We are solely responsible for addressing product liability claims, regulatory compliance issues, and consumer protection matters
- Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you
13. INDEMNIFICATION
You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, or expenses (including attorney fees) arising from:
- Your use of our service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Content you submit through our service, including images you do not have rights to use
- Your breach of any representation or warranty in these Terms
- Your use or misuse of AI-generated content
14. TERMINATION
We may terminate or suspend your account and access:
- If you violate these Terms
- If we suspect fraudulent, illegal, or abusive activity
- If required by law or regulation
- If your subscription payment fails
- If you upload infringing or inappropriate content
- At our discretion with reasonable notice for other reasons
You may terminate your account at any time by:
- Canceling your subscription through your Apple App Store account settings
- Contacting our support team to request account deletion
- Using in-app account deletion features where available
Effect of Termination:
- Your access to premium features will end immediately
- Unused credits will be forfeited upon termination
- Your data may be retained according to our Privacy Policy and data retention schedule
- You can request data deletion upon account termination
- Some provisions of these Terms survive termination
15. GOVERNING LAW AND DISPUTES
- These Terms are governed by the laws of Switzerland
- Any disputes will be resolved in the courts of Switzerland or through binding arbitration where permitted by law
- You waive your right to participate in class action lawsuits where permitted by law
- If arbitration is not permitted or enforceable, disputes will be resolved in the appropriate courts
- The prevailing party in any dispute may be entitled to attorney fees
16. CHANGES TO TERMS
We may update these Terms from time to time to reflect:
- Changes in our services or business practices
- New legal requirements or regulations
- Enhanced user protections or clarifications
We will notify you of material changes by:
- Posting updated Terms in the app with prominent notice
- Sending an email notification to your registered email address
- Providing in-app notifications about significant changes
- For material changes: 30 days advance notice
Continued use of our service after changes constitutes acceptance of the updated Terms.
17. SEVERABILITY AND ENTIRE AGREEMENT
- If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and Augmntd regarding your use of Auglie
- These Terms supersede any prior agreements or understandings
- Platform providers and their subsidiaries are third-party beneficiaries of these Terms and may enforce them directly against you
